Terms of Service

These Terms of Service ("Terms") govern your access to and use of Mivvo, an iOS application operated by Mesih Malik Kuru ("we," "us," or "our"). By downloading, installing, or using Mivvo, you agree to be bound by these Terms. Please read them carefully before using the application.

1. Acceptance of Terms

By accessing or using Mivvo, you confirm that you are at least 18 years of age, that you have read and understood these Terms, and that you agree to be legally bound by them. If you are under 18 years of age, you are not permitted to use Mivvo and must not download, install, or create an account.

You acknowledge that Mivvo is an adult-oriented application that may contain mature themes, including romantic and suggestive content generated by AI characters. By using the application, you confirm that you are of legal age in your jurisdiction to access such content.

If you are using Mivvo on behalf of an organization or entity, you represent and warrant that you have the authority to bind that organization to these Terms, and that the organization agrees to be bound by them. In that context, "you" refers to the organization.

We reserve the right to modify these Terms at any time. When we make material changes, we will notify you through an in-app notification or other reasonable means. Your continued use of Mivvo after any changes constitutes your acceptance of the revised Terms.

2. Description of Service

Mivvo is an iOS mobile application that allows users to chat with AI-powered characters and view AI-generated stories created by those characters. Each AI character has a distinct personality, backstory, and communication style. Characters post stories — short-lived visual updates — throughout the day, and users can engage with these characters through text-based conversation.

The service includes both free features and premium features accessible through in-app purchases and subscriptions. We may update, modify, add, or remove features at any time at our discretion. We will make reasonable efforts to communicate significant changes that affect your use of the service.

3. Account Registration

To use Mivvo, you must create an account by signing in with Apple Sign In or Google Sign In. By using these sign-in methods, you authorize us to access the basic profile information provided by those services to create and maintain your Mivvo account.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at support@getmivvo.app if you become aware of any unauthorized access to or use of your account. We are not liable for any loss or damage arising from your failure to maintain the security of your account.

You may only create one account per person. Creating multiple accounts to circumvent restrictions, bans, or purchase limits is prohibited and may result in termination of all associated accounts.

4. Acceptable Use

You agree to use Mivvo only for lawful purposes and in a manner consistent with these Terms and all applicable local, national, and international laws and regulations. In particular, you agree that you will not:

• Use the application to engage in any activity that is illegal, fraudulent, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.
• Attempt to gain unauthorized access to any part of the application, its servers, databases, or any systems or networks connected to the service.
• Use automated tools, bots, scrapers, or other means to access, collect, or interact with the service in a manner not intended by us.
• Attempt to reverse engineer, decompile, disassemble, or otherwise derive source code from any part of the application.
• Upload, transmit, or encourage any content that contains viruses, malware, or other harmful or malicious code.
• Harass, threaten, or intimidate other users or our support staff.
• Misrepresent your identity or affiliation with any person or entity.
• Use the service in any manner that could damage, disable, overburden, or impair the infrastructure of the application.
• Attempt to manipulate the AI characters into producing content that violates these Terms or applicable law.

We reserve the right to investigate suspected violations of these Terms and to take any action we deem appropriate, including removing content, suspending access, or terminating accounts.

5. User Content

Mivvo allows you to send messages to AI characters. You retain ownership of the original content you create and submit through the application, including the messages you send ("User Content"). You are solely responsible for your User Content and the consequences of submitting it.

By submitting User Content, you grant us a limited, non-exclusive, royalty-free, worldwide license to store, process, and use your User Content solely for the purpose of operating and delivering the Mivvo service to you. This includes generating AI responses contextually appropriate to your conversation. This license does not grant us the right to sell your User Content or use it for advertising.

We may review, monitor, and, where necessary, remove User Content that we believe violates these Terms or applicable law, without prior notice to you. We do not take responsibility for any User Content submitted by you or other users, and we do not endorse any opinions or views expressed through User Content.

6. AI-Generated Content

The responses generated by AI characters in Mivvo, as well as the stories posted by those characters, are produced by artificial intelligence models and are not written by human beings. AI-generated content is provided for entertainment and companionship purposes only. Some AI-generated content may include mature or suggestive themes intended for adult audiences.

We make no representations or warranties regarding the accuracy, completeness, reliability, or appropriateness of any AI-generated content. AI responses may occasionally be inconsistent, incorrect, or unexpected. You should not rely on AI-generated content as a substitute for professional advice of any kind, including but not limited to medical, legal, financial, psychological, or any other professional advice.

AI characters in Mivvo do not have feelings, consciousness, or real-world agency. Any sense of emotional connection or relationship with an AI character exists entirely within the context of the application and does not constitute a real interpersonal relationship. We encourage you to maintain a healthy balance in your use of the application.

7. In-App Purchases and Subscriptions

Mivvo offers credits and subscription plans that unlock premium features, including expanded messaging and story interactions. All in-app purchases and subscriptions are processed through the Apple App Store. By making a purchase, you agree to Apple's terms and conditions in addition to these Terms.

Credits are non-refundable consumable items that are used to unlock certain interactions within the app. Credits do not expire as long as your account remains active.

Subscriptions are recurring billing arrangements that automatically renew at the end of each billing period unless you cancel at least 24 hours before the end of the current period. Subscription fees are charged to your Apple ID account at confirmation of purchase and at the start of each renewal period.

You can manage and cancel your subscriptions at any time through your Apple ID account settings. Canceling a subscription will prevent future charges but does not entitle you to a refund for the current billing period, except where required by applicable law.

All refund requests for in-app purchases and subscriptions must be submitted directly to Apple, as Apple handles all payment processing. We do not have the ability to issue refunds directly. To request a refund, please visit reportaproblem.apple.com.

We reserve the right to change pricing and available plans at any time. Price changes will be communicated in advance and will take effect at the start of your next billing period.

8. Intellectual Property

The Mivvo application, including its design, visual elements, AI character concepts, stories, branding, and all original content created by us, is the exclusive property of Mesih Malik Kuru and is protected by copyright, trademark, and other applicable intellectual property laws. Nothing in these Terms grants you any ownership interest in the application or its original content.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the application for your personal, non-commercial purposes, strictly in accordance with these Terms. You may not copy, modify, distribute, sell, sublicense, or create derivative works based on any part of the application without our prior written consent.

User-generated content, as described in Section 5, remains the property of the respective user, subject to the limited license granted to us to operate the service.

9. Privacy

Your use of Mivvo is also governed by our Privacy Policy, which is incorporated into these Terms by reference. The Privacy Policy describes how we collect, use, and protect your personal information. 10. Disclaimer of Warranties

Mivvo is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied. To the fullest extent permitted by applicable law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising out of course of dealing or usage of trade.

We do not warrant that the application will be uninterrupted, error-free, or free from viruses or other harmful components. We do not warrant that the results obtained from using the application will be accurate or reliable. You assume full responsibility for your use of the application and any decisions made in reliance on AI-generated content.

11. Limitation of Liability

To the fullest extent permitted by applicable law, Mesih Malik Kuru shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, loss of goodwill, service interruption, computer damage, or the cost of substitute services, arising out of or in connection with your use of, or inability to use, Mivvo or its content, whether based on contract, tort (including negligence), strict liability, or any other legal theory, even if we have been advised of the possibility of such damages.

In jurisdictions that do not allow the exclusion or limitation of liability for consequential or incidental damages, our liability is limited to the maximum extent permitted by law.

Our total aggregate liability to you for any claims arising out of or relating to these Terms or your use of Mivvo shall not exceed the greater of (a) the amount you paid to us in the twelve months immediately preceding the event giving rise to the claim, or (b) fifty US dollars (USD $50).

12. Termination

We reserve the right to suspend or terminate your access to Mivvo at any time, without prior notice, if we reasonably believe you have violated these Terms, engaged in fraudulent or illegal activity, or posed a risk to the security or integrity of the service or other users.

You may terminate your relationship with us at any time by deleting your account from within the application. Upon account deletion, your personal data will be removed in accordance with our Privacy Policy.

Upon termination of your account for any reason, your right to use the application immediately ceases. Unused credits and subscription benefits are forfeited upon termination for cause. Sections of these Terms that by their nature should survive termination — including but not limited to intellectual property provisions, disclaimers of warranties, limitations of liability, and governing law — shall survive termination.

13. Changes to Terms

We may modify these Terms at any time. When we make material changes, we will provide notice through an in-app notification or by updating the "Last updated" date at the top of this page. Minor changes may be made without specific notice beyond updating this page.

Your continued use of Mivvo after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree with the revised Terms, you must stop using the application and may delete your account.

14. Governing Law

These Terms and any disputes arising out of or related to them or your use of Mivvo shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law provisions.

Any legal action or proceeding arising out of or related to these Terms shall be brought exclusively in the competent courts of the Republic of Turkey. By using Mivvo, you consent to the personal jurisdiction of such courts and waive any objection to the exercise of jurisdiction over you by such courts.

Notwithstanding the foregoing, nothing in this section limits your rights as a consumer under the mandatory consumer protection laws of your country of residence.
